These Terms of Service (“Terms”) govern your use of ShouldApply, a web application operated by Jesse Johnson (“we,” “our,” or “us”), accessible at shouldapply.com (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using ShouldApply, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To access the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

ShouldApply is a job search tool that helps you evaluate how well your qualifications match job descriptions. The Service allows you to:

  • Upload your resume and build a professional profile
  • Search for and paste job descriptions
  • Receive AI-generated match scores and analysis
  • Track and organize your job search

4. AI-Generated Content

Match scores, analysis, and recommendations provided by the Service are generated using artificial intelligence (Google Gemini API). You acknowledge and agree that:

  • AI-generated results are informational only and should not be the sole basis for employment decisions
  • Scores are estimates based on text analysis and do not guarantee interview invitations or job offers
  • AI may produce inaccurate, incomplete, or biased results
  • We do not guarantee the accuracy, reliability, or completeness of any AI-generated content
  • You are responsible for independently verifying job details, requirements, and company information

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false, misleading, or fraudulent information
  • Scrape, crawl, or use automated tools to extract data from the Service
  • Attempt to gain unauthorized access to our systems or other users’ accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use the Service to harass, spam, or harm others
  • Resell, redistribute, or commercially exploit the Service without our written consent

6. Your Content

You retain ownership of all content you submit to the Service (resumes, profile data, notes, etc.). By submitting content, you grant us a limited, non-exclusive license to use, process, and store your content solely for the purpose of providing and improving the Service.

You represent that you have the right to submit all content you provide and that your content does not infringe on any third party’s rights.

7. Intellectual Property

The Service, including its design, code, algorithms, branding, and original content, is owned by Jesse Johnson and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

8. Payment & Subscriptions

ShouldApply may offer free and paid tiers. If you subscribe to a paid plan:

  • You agree to pay the fees as described at the time of purchase
  • Payments are processed securely through Stripe
  • Subscriptions auto-renew unless cancelled before the renewal date
  • Refunds are handled on a case-by-case basis; contact us at jesse@shouldapply.com

We reserve the right to change pricing with reasonable notice to existing subscribers.

9. Limitation of Liability

To the maximum extent permitted by law, ShouldApply and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of employment opportunities based on match scores
  • Decisions made in reliance on AI-generated analysis
  • Data loss or unauthorized access due to factors beyond our reasonable control
  • Interruptions or errors in the Service

Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Results obtained from the Service will be accurate or reliable
  • Any defects will be corrected

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in our Privacy Policy.

12. Termination

You may delete your account at any time through your account settings or by contacting us.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if continued access poses a risk to the Service or other users.

Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in King County, Washington.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
